Mr. Herzberg’s practice focuses on the representation of clients in transactions and disputes regarding real estate, commercial law, and aviation matters. He has successfully represented various entities and individuals in commercial and residential real estate transactions, financing matters, and real estate development projects.

Mr. Herzberg’s real estate practice focuses on representing companies and individuals in the acquisition, financing, and sale all classes of commercial and residential real estate, including shopping centers anchored by national tenants, large multi-family properties, office complexes, warehouses, and luxury residential properties. At the firm he has advised clients in hundreds of real estate transactions with a total value in excess of $2.0 billion. Such acquisition and disposition representations include advising clients on transactions involving some of the largest real estate investments funds in the U.S.

Additionally he has represented landlords and tenants in numerous long-term leases that exceed terms of 30-years for retail space, restaurant space, office space, and land leases.

Mr. Herzberg has also represented clients in commercial and civil disputes in Florida state courts, the Florida District Court of Appeals, and Federal Court. This provides a unique perspective to his transactional work. With significant dispute resolution and litigation experience he understands what needs to be done to prevent and mitigate future disputes or litigation

Prior to joining the firm, Mr. Herzberg was corporate counsel for a real estate investment fund in South Florida. Born and raised in Miami, he obtained degrees in Geography and International Affairs from The George Washington University in Washington D.C. He went on to attend and graduate cum laude from the University of Miami School of Law. Mr. Herzberg is also a Councilmember-Elect for the Town of Miami Lakes and will take public office in November 2024.

Experience

Represented real estate investor in the purchase of 560-unit 560,000 square foot multifamily complex in Houston, Texas, which included the assumption of a $38-million securitized commercial mortgage held by Citigroup

Represented real estate investor in the purchase and financing of 232,000 square foot commercial retail center in Lewisville, Texas.

Represented real estate investor in the $31,000,000.00 purchase and financing of 325-unit 24-acre multifamily complex in Jacksonville, Florida.

Represented local tour boat operator in obtaining city approval for the long-term lease of City of Miami waterfront property through a city Request for Proposal.

Has represented various property owners in the negotiation and drafting of long-term commercial leases across Florida, the U.S. and abroad, including built to suit leases, predevelopment leases, land leases, and leases with Fortune 500 tenants.

Represented a world leading Indian based agriculture company and its Argentina and Mauritius subsidiaries in the successful dismissal and defense of subsequent appeal in the Third District Court of Appeals of Florida regarding a seven-figure breach of contract dispute against a Latin American international cargo airline. Transcarga Intl. Airways, C.A. v. Advanta Seeds International, 274 So.3d 491 (Fla. 3d DCA 2019).

Represented real estate investor in trial and subsequent appeal in defense of allegations that prior transaction was invalid, and property line dispute. Successfully obtained judgment in favor of our client on all counts and affirmation of the lower court’s judgment in the Third District Court of Appeal. Pena v. Rincon, 327 So.3d 459 (Fla. 3d DCA 2021).

Represented various international and domestic corporations with the purchase, sale, leasing, and management of various classes of aircraft.

Have represented various purchasers and sellers of commercial properties throughout South Florida and the U.S. including the purchasing of national anchored retail shopping centers, real estate portfolios, multifamily properties, distressed commercial property, development sites, hotels, luxury homes, spec home development lots, and warehouses.
